1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (whether individually or on behalf of an entity) and Node Orbit Point Co., Ltd. (“Node Orbit Point,” “we,” “us,” or “our”), governing your access to and use of our website located at node-orbitpoint.click and all analytical consulting and diagnostic advisory services provided by us.

By accessing this website, submitting an inquiry, or commissioning a service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

2. Description of Professional Services

Node Orbit Point Co., Ltd. provides bespoke, human-led cohort retention analysis, mobile event taxonomy audits, and onboarding funnel diagnostic services for iOS and Android mobile applications.

All engagements are executed according to individual written Statements of Work (SOW) or engagement agreements mutually signed by both parties. Any pricing or timelines shown on this website represent informational guidance and standard estimates.

3. Intellectual Property Rights

• Proprietary Materials: The structure, design, visual origami-themed assets, code, articles, guides, and text on node-orbitpoint.click are the exclusive intellectual property of Node Orbit Point Co., Ltd., protected under applicable intellectual property and copyright legislation.
• Client Data & Engagement Deliverables: The client retains full ownership of their proprietary application telemetry, raw user event data, and business metrics provided during an engagement. Upon receipt of full payment, the client owns the final tailored written audit dossier and action blueprint produced specifically for their mobile application.
• Methodological Frameworks: Node Orbit Point retains ownership of its proprietary diagnostic processes, analysis frameworks, mathematical templates, and underlying analytical toolsets.

4. Client Obligations & Data Access

To enable the performance of diagnostic services, the client agrees to:

1. Provide accurate, authorized, and lawful read-only access to relevant mobile event logs, warehouses, or analytics schemas.
2. Ensure that any data shared complies with applicable data protection regulations and does not contain unmasked sensitive personal financial, medical, or government identification data.
3. Appoint a primary technical or product contact to participate in scheduled kickoff and debrief sessions.

5. Professional Advisory Disclaimer & Limitation of Liability

• Advisory Nature: All deliverables, retention models, and remediation recommendations provided by Node Orbit Point are advisory in nature. While our analyses are conducted with senior professional care and mathematical rigor, implementation decisions and their commercial outcomes remain the sole responsibility of the client.
• No Warranty: We do not warrant that implementation of audit recommendations will guarantee specific percentage increases in commercial revenue or user retention.
• Liability Cap: To the maximum extent permitted by applicable law, in no event shall Node Orbit Point Co., Ltd., its directors, employees, or contractors be liable for any indirect, punitive, incidental, special, or consequential damages. Our aggregate liability arising out of any engagement shall not exceed the total fees actually paid to us by the client for the specific service giving rise to liability.

6. Confidentiality & Non-Disclosure

We maintain strict confidentiality regarding all proprietary client telemetry, business numbers, event schemas, and product roadmap details disclosed during the course of an engagement. We do not sell, disclose, or distribute client data to any third party. Specific non-disclosure agreements (NDAs) are executed prior to data access upon client request.

7. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or related to our services shall be governed by and construed in accordance with the laws of the Kingdom of Thailand (TH), without regard to its conflict of law principles.

Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the competent courts of Chiang Mai, Thailand. Both parties consent to the jurisdiction and venue of such courts.

8. Amendments & Modifications

We reserve the right to revise and update these Terms at any time. Changes become effective immediately upon posting to this website with an updated revision date.
